We mark the proprietary apps as proprietay with tags in manifest files.

Flathub list some ass proprietay but shows them as Special License?

Using tags in the Flatpak manifest is not needed. It was never used for anything substantial, not used for anything currently and doesn’t have any effect. The licence in the Metainfo is the ultimate truth.
It’s kept in flatpak-builder as a legacy artifact for backwards compat.
